Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of Maca, including our desktop app and web platform at maca.sh (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The service

Maca is a voice-to-text application that transcribes your speech and can act on it using automated and AI-powered features. We may add, change, or remove features at any time as the Service evolves.

Eligibility and accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Maca. You are responsible for the accuracy of the information you provide, for keeping your account credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Record or transcribe others without obtaining any consent required by law.
• Attempt to reverse engineer, interfere with, or disrupt the Service or its infrastructure.
• Use the Service to generate or distribute harmful, abusive, or infringing content.
• Resell or commercially exploit the Service without our written permission.

Subscriptions, billing, and refunds

Maca offers free and paid plans. Paid subscriptions are billed in advance on a recurring basis through our payment processor, and they renew automatically until you cancel. You can cancel at any time, and your plan will remain active through the end of the current billing period. Except where required by law, payments are non-refundable. We may change our prices, and we will give you reasonable notice before a change affects you.

Your content

You retain all rights to the audio you record and the transcripts you generate with Maca (your "Content"). You grant us a limited license to process your Content solely to provide the Service to you, including sending it to the service providers described in our Privacy Policy. You are responsible for your Content and for ensuring you have the rights necessary to submit it.

Intellectual property

The Service, including its software, design, and trademarks, is owned by Maca and its licensors and is protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding. We welcome feedback, and you agree that we may use it without restriction or obligation to you.

Third-party services

The Service relies on third-party providers for authentication, transcription, AI processing, payments, hosting, and analytics. Your use of those features may also be subject to the providers' terms. We are not responsible for third-party services that we do not control.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that transcriptions or AI-generated outputs will be accurate, complete, or error-free, or that the Service will be uninterrupted or secure. You are responsible for reviewing outputs before relying on them.

Limitation of liability

To the maximum extent permitted by law, Maca and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars.

Indemnification

You agree to indemnify and hold harmless Maca and its affiliates from any claims, damages, liabilities, and expenses arising out of your Content, your use of the Service, or your violation of these Terms or applicable law.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination, such as ownership, disclaimers, and limitations of liability, will survive.

Governing law

These Terms are governed by the laws of the United States and the state in which Maca is established, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located there, unless applicable law requires otherwise.

Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you through the app or by email. Your continued use of the Service after an update means you accept the revised Terms.
